No Win No Fee Injury Claims

January 21, 2009 / No Comments / Accident Claims

The term “No Win No Fee” has tarnished the world of personal injury claims in recent years, mainly due to high and sometimes unfair fees charged by some accident claims companies who act as middle-men between the person who has been injured and the Solicitor who handles the claim.

Accident claims companies often charge large success fees (sometimes as high as 40%) which can be deducted from compensation payments, this is sometimes despite eye catching adverts which can give the impression that no deductions will be made.

For many injured people the term No Win No Fee is no longer the attractive proposition it once was when it comes to deciding how their personal injury claims will be handled.

Some Solicitors are working hard to try and encourage people to cut out middle-men and speak to a Solicitor directly by raising awareness that they will not charge clients a penny to handle a personal injury claim – Win or Loose, instead of the phrase “No Win, No Fee” it has now become “No Win, No Fee – Win, No Fee“.

It can be confusing deciding what to do when you are injured in an accident, but the right advice is to speak directly to a specialist Personal Injury Solicitor, rather than an accident claims handling company.

By speaking directly to a Solicitor you will benefit in the following ways:

  • Most claims companies act as a middle man and will sell your claim onto a Solicitor for a fee
  • Many claims companies will charge a large success fee and deduct it from your compensation
  • You will speak directly to a fully qualified Solicitor, not a phone operator in a call centre
  • Solicitors are regulated by the Law Society giving clients protection at all times
  • Most Solicitors will provide free advice on how you can progress your compensation claim
  • Many Solicitors will not charge you a penny, win or loose, meaning you keep 100% compensation

No Win No Fee – Win No Fee, so how can a Solicitor not charge a fee?

Solicitors are able to handle personal injury claims on a no fee basis because they claim back their costs from the insurance company of the person responsible for the accident. In the unlikely event that the claim does not succeed the legal fees will either be written off or paid by an insurance policy taken out on the clients behalf.

Expert rehabilitation network

It’s not just about claiming compensation.

Most specialist personal injury Solicitors first priority will be to ensure their client makes the quickest and fullest recovery from their injuries as possible.

Solicitors are best placed to do this as they have access to networks of private medical rehabilitation specialists such as physiotherapists, osteopaths and other experienced medical experts.

Clients would be charged no fee for private medical treatment, the cost is claimed from the insurance company of the party responsible for the accident.
