Pavement Kerb Accident Claims

A woman who fell after stepping in a hole in the road while pregnant has been awarded £3500 in damages.

The lady, aged 29, was several months pregnant in September, 2003, when the accident happened. She was carrying a pram chassis to her car, so did not see the hole in the road as she stepped off the pavement. As she stepped off the kerb, her foot landed in the hole and she went over on her ankle.

Awarding judgment against the city council, the Judge said the hole, about a yard square and two inches deep, posed a significant danger.

It had been there since at least 2001 and was only filled in after the accident.
