Hospital Superbug (MRSA & C Difficile) compensation claims can now finally be made against hospitals using workplace safety legislation.

Until recently the NHS could dispute claims as it cannot tell exactly when a person becomes infected with MRSA or C Difficile.

Claim For Whiplash Injury

Whiplash!

Whiplash is the common name for neck sprains, such as those caused by injury to the spine. The injury is referred to as “whiplash” due to the neck or back being thrown forwards and/or backwards at rapid speed. This may cause the fibres of the neck muscles to tear, resulting in pain and often a decreased range of movement. Whiplash and whiplash-associated disorders (WAD) represent a range of injuries to the neck that can be caused by or related to a sudden distortion of the neck.

Whiplash is most commonly associated with car accidents however the injury can be sustained in many other ways, including falls from bicycles or horses.

I recently settled a claim for a family in Brentford who suffered shock when a crane toppled over and went through the roof of their house in the early hours of the morning. They suffered no physical injury, but to be awoken suddenly with people screaming at you to get out of your house in case it collapsed was truly frightening.

Mr K is a retired gentleman approaching his 70th birthday. To keep himself active and to make a contribution to the community Mr K had a small part time job working as a verger to his local church. Mr K’s duties included the performance of small maintenance and repair tasks within the church. In particular on a number of occasions he was asked to clean the church’s Oriel window which was quite high up on the church.

Unfortunately the church did not provide Mr K with the proper facilities and support to enable him to safely reach up to clean the Oriel window. In fact he was left to use a small domestic ladder and in due course the inevitable happened; Mr K was up the ladder struggling to clean the Oriel window when the ladder slipped from underneath him and he fell.

A two-year-old girl was bitten in the face by a dog that had been tied up outside a Tesco supermarket. Another man and a security guard were also bitten outside the Tesco store.

A spokesman for the police said the dog was thought to be a five-year-old Alsatian or Labrador cross. She said the girl, who was with a child minder at the time, needed stitches and was left with a bite mark on her face.

“It was a nasty bite.” The toddler had five stitches to her lip and nose.

The opportunity for foreign travel has never been so good and every year thousands more people are taking the opportunity to benefit from budget airlines.

Unfortunately, accidents do happen abroad. Many people might not be aware of their entitlement to pursue a claim for compensation when the accident occurs outside of their own country.
