Payment Protection Insurance (PPI) has been banned by the Competition Commission after it went ahead with plans to ban the sale of PPI when it is attached to a personal loan or a credit card.

The Competition Commission said that credit card companies and personal loan providers have an unfair advantage as they can sell PPI at the same time someone signs up to a personal loan or credit card.

Payment Protection Insurance has been widely mis-sold with worst cases involving the PPI premiums being over 50% of the amount of money borrowed. Banning the practice of selling PPI alongside a loan or credit card will undoubtedly encourage much more price competition and a fair market for consumers.

It is also likely that a cooling off period will be introduced later this year to ensure that consumers who sign up to a loan or a credit card have enough time to consider alternative products and providers.

Pinto Potts Solicitors are specialists in dealing with compensation claims for mis-sold payment protection insurance, if you have a loan or credit card with PPI attached to it we may be able to help you.

No Win, No Fee Explained, what does “No Win, No Fee” mean?

Apart from family, property or criminal matters, many types of claim are suitable for a Conditional Fee Agreement, which is commonly known as a ‘No Win, No Fee’ agreement.

What happens if your claim is successful?

In a ‘No Win, No Fee’ agreement your solicitor will only be paid if the claim is successful, he or she will also be entitled to an extra fee (known as a success fee). Both the basic fee and this extra fee are normally paid in whole or part by the losing party.  There are other incurred costs (such as court fees or the fee for a medical report). These are normally known as disbursements. Again, the losing party should pay all (or sometimes part ) of these costs.

What happens if your claim fails?

You will not have to pay your own solicitor, but you may be liable to pay the costs of the successful party – the other side. Also, you may be laible for any other incurred costs (such as court fees or the fee for a medical report), these are normally known as disbursements. However, your solicitor will normally arrange insurance to cover this risk. This is known as ‘after the event’ insurance, in the event of the claim failing the insurance would then cover any money due from you.

A new study has revealed that many UK motorists are increasing their chances of having a car accident by getting behind the wheel when they are too tired to do so.

The survey suggested that large numbers of drivers are significantly increasing their chances of having a road traffic accident by driving their car without having adequate sleep the night before.

The study showed that 80% of drivers surveyed had gone to bed after 10pm the previous night and a worrying figure of 86% admitted having less than the recommended minimum of 8 hours sleep.

Two-thirds of motorists surveyed said they were often unable to sleep and said that this has had an impact on their concentration levels when driving the following day.

Alarmingly 75% of the drivers who took part in the survey admitted to driving their car to work through the morning rush hour without a healthy amount of sleep.

Driving while tired is dangerous, but sometimes unavoidable, for tips on how to stay alert behind the wheel and more about driving while tired visit the Safer Motoring website.

Mobility scooters provide an excellent means of transport and help provide independence for around 300,000 people in the UK affected by mobility problems such as disability or obesity.

However, the huge rise in the use of mobility scooters on the UK’s roads and pavements has resulted in an increase in accidents in which pedestrians are injured by mobility scooters.

Currently it is very difficult to make a personal injury compensation claim against the driver or owner of a mobility scooter as the vehicles are ”unclassified” and normally have no insurance cover to claim against.

However MPs are urging for mobility scooters to be classified and for drivers to be forced to take a driving ability test to ensure they are competent to drive a scooter, it is also likely they will recommend mobility scooter drivers have suitable insurance to cover anyone who is injured in an accident with one.

In the last twelve months one pedestrian has been fatally inured and a toddler was hurt after being hit by mobility scooters, the electric powered scooters can travel at up to 8mph (12.8km/h) and weigh up to 150kg, currently there is no assessment as to whether someone is fit to drive a mobility scooter.

It is hoped that MPs will move quickly to deal with the issues brought about by the increased popularity of mobility scooters and will provide reassurance to pedestrians and members of the public that they will be protected if they are unlucky enough to be involved in an accident with one.
