A proposal by the Government to retain the exisiting limit for small claims at £1,000 for personal injury and housing disrepair has been welcomed by the Law Society. The retention of the limit will safeguard access to justice and enable people to get legal help when bringing potentially complex claims.
A spokesman for the Law Society said:
“I’m pleased that the Government has accepted the evidence in the Law Society’s ‘Fast and Fair’ campaign that an increase in the small claims limit for personal injury cases would deprive many people injured as a result of someone else’s negligence of compensation. We agree with the Government that the right approach is to improve the process for dealing with lower value cases rather than depriving people of help from a solicitor.”
The consultation paper, ‘Case track limits and the claims process for personal injury claims’, also recommends raising the fast track limit to £25,000 and the introduction of a streamlined claims process for personal injury claims under £25,000.
“In our ‘Fast and Fair’ campaign, the Law Society proposed the development of a streamlined process for lower value personal injury claims to ensure that injured people continue to have help from a solicitor and which also ensures the claim is dealt with proportionately. The Government’s proposals draw heavily on that work and we look forward to responding in detail to the consultation.”
